ACCEPTABLE USE, REVIEWS AND CONTENT POLICY

Rules for listings, reviews, user-generated content, prohibited items, fake ratings, IP complaints and account misuse on the Parivan Platform

Operated in Nepal only  ·  Single operating establishment  ·  Multi-vendor apparel marketplace (intermediary)
Issued: 03 September 2026  ·  Document: PARIVAN-POL-AUP-001  ·  Version 1.0

COMPLETION REQUIRED.  Placeholders in square brackets (for example [COMPANY LEGAL NAME]) must be completed with the registered particulars of the operating company before these documents are published or executed. Until then, these drafts are internal working documents and must not be treated as executed contracts.

1. PURPOSE

This Policy forms part of the Terms and Conditions of [COMPANY LEGAL NAME] (“Parivan”). It exists because the Electronic Commerce Act, 2081 prohibits fake reviews, misleading listings and unfair trade, and because unmanaged user content is a defamation, IP and public-order risk. It applies to Buyers, Vendors and visitors.

2. PROHIBITED CONTENT

You must not upload, list or transmit anything that:

·    is unlawful under Nepal law, including sexually explicit content involving minors (zero tolerance), obscenity, hate, caste or communal incitement, or content that threatens the sovereignty, integrity or public peace of Nepal;

·    is defamatory, harassing, or an invasion of privacy;

·    infringes copyright, trademark, design or personality rights;

·    is a fake review, incentivised undisclosed review, or review of goods the author did not purchase on Parivan (Vendors must not review their own listings, directly or through proxies);

·    misrepresents the product (including AI images that alter colour, shape or fabric);

·    contains malware, spam, or attempts to harvest other users’ data;

·    shares another person’s personal data (phone, address, citizenship) without a lawful basis;

·    solicits off-platform payment or contact in order to bypass Parivan.

3. REVIEWS

Reviews must be based on a genuine Parivan order. Photos should be of the product received. We may verify, edit for length, or remove reviews that breach this Policy. We will not suppress a lawful negative review of a Vendor to protect that Vendor. We will remove a review that is abusive of a person rather than descriptive of a product. Star ratings are opinions, not warranties by Parivan.

4. PROHIBITED AND RESTRICTED GOODS

Parivan is an apparel-focused marketplace. Even if the catalogue expands, the following may not be listed: illegal drugs and paraphernalia; weapons and explosives; stolen goods; counterfeit branded goods; wildlife and products banned under CITES or Nepal law; prescription medicines; hazardous chemicals; live animals; tobacco and vapes if prohibited for e-commerce; any good requiring a licence the Vendor does not hold. Intimate wear may be listed only with hygiene-seal and return restrictions as in the Return Policy.

5. INTELLECTUAL PROPERTY COMPLAINTS

If you believe a listing or review infringes your IP, write to [LEGAL EMAIL] with: your name and contact; proof of rights; URL of the infringing listing; a statement that the information is true. We operate a notice-and-takedown process. We may remove content pending review. Exclusive-distribution disputes that are not IP infringement are a matter between brand and Vendor; we are not obliged to enforce private distribution contracts. False complaints may themselves be actionable.

6. NOTICE AND TAKEDOWN OF OBJECTIONABLE CONTENT

Report objectionable content to [LEGAL EMAIL] or the Grievance Officer. We will investigate and, where valid, remove within a reasonable time. Provide enough detail; incomplete reports may not be actionable.

7. ENFORCEMENT

We may remove content, pause listings, convert a Buyer to prepaid-only, suspend or terminate accounts, hold Vendor payout, and report to Nepal Police or the Department. We may do so without prior notice where harm is imminent (child-safety, fraud in progress, malware).

8. CLAIMS AGAINST PARIVAN CONTENT

House content (Parivan photographs, copy, software) is ours. You may not copy the catalogue. Limited quotation for a personal non-commercial review is allowed.

DOCUMENT CONTROL

This document is issued by the operator of the Parivan Platform for use in Nepal only. It should be read with the other Parivan legal documents in force at the time of the relevant order or onboarding. If there is a conflict between a promotional statement and this document, this document prevails. If there is a conflict between this document and a mandatory provision of Nepalese law, the mandatory provision prevails.

This pack is prepared as a working legal draft aligned with the Electronic Commerce Act, 2081 (2025), the Consumer Protection Act, 2075 (2018), the Individual Privacy Act, 2075 (2018), the Electronic Transactions Act, 2063 (2008), and the Companies Act, 2063 (2006), as commonly applied to a Nepal-only intermediary marketplace. It is not a substitute for a licensed Nepalese advocate’s final review, stamping (where required), or company-board adoption.
